The court of appeal in Abuja has committed Akan Okon’s appeal to flames, dismissed it and has literary flung it out of the window for lacking in merit.

The court said it was funny that the appellant, Akan Okon who was not a member of the a group nor a staff of WAEC presented a document purportedly issued to the group as evidence in court.

The court also upheld the decision of the lower court to ignore the forensic expert.

The court also held that the lower court was right to have accepted the evidences of subpoenaed witnesses without allowing them to testify.

The court ruled that despite the failure of the respondents to file a reply or brief of arguments, the appeal must still be meritorious before it can be upheld.

The Appeal Court held that the burden of proving the criminal allegation is on the petitioner and that Akan Okon failed to prove that Pastor Umo Eno forged his certificates.

The Court of appeal has upheld the judgement of the Federal High Court. N15million cost awarded by the lower court reduced to N5m
